Limited edition prints.
Personalized art commissions.
Downloadable digital content and products.
These terms shall apply to all purchases made through the online store, without prejudice to any particular terms that may be established for certain products.
Where a particular term of the product is more beneficial to the consumer, that particular term shall prevail.
Acceptance of the terms
Before completing a purchase, the customer must have access to these General Terms and Conditions of Sale and must accept them where required in the contracting process.
Acceptance shall be made by means of an express and unequivocal action.
Acceptance of these terms implies that the customer:

Original works
Original works are one-of-a-kind artistic pieces made by La Correa Creativa.
Unless expressly stated otherwise on the product page, each original work:
- Is a one-of-a-kind piece.
Is delivered with a certificate of authenticity.
May present characteristics typical of a manually created artistic work.
May present small variations in texture, pigmentation, paper or finish inherent to its creation process.
The purchase of an original work transfers to the buyer the ownership of the physical medium acquired, but does not transfer the intellectual property rights or exploitation rights over the work.
The buyer may enjoy and display the acquired work, but may not reproduce it, market copies or exploit its copyright without authorization.
Prints and limited editions
The prints marketed by La Correa Creativa may be part of limited editions.
In the case of a limited edition, the product page shall indicate, where applicable:

Printing technique.
Paper used.
Dimensions.
Signature.
Other elements of authenticity.
Once the maximum number established for a limited edition has been reached, that edition may be considered sold out.
The purchase of a print does not grant the buyer any reproduction or exploitation rights over the reproduced image.
Personalized commissions
La Correa Creativa may offer the creation of personalized works or illustrations.
Before starting a commission, the following shall be established, as applicable:
- Characteristics of the work.
Technique.
Dimensions.
Number of persons or objects depicted.
Materials.
Estimated timeframe.
Price.
Method of payment.
Specific terms of the project.
The commission shall not begin until the terms have been accepted and, where applicable, the agreed payment or deposit has been received.
Due to their personalized nature, commissions made in accordance with the customer's specifications may be excluded from the right of withdrawal under the terms provided by consumer legislation. The regulations specifically provide for the exception for goods made to the consumer's specifications or clearly personalized.
However, this exclusion does not affect the rights of the consumer in the event of lack of conformity, defect or breach of contract.
Digital downloads
La Correa Creativa may market digital content that is not delivered on a physical medium.
Before the purchase, information shall be provided about the main characteristics of the file or digital content, including, where applicable:

Dimensions.
Number of files.
Download system.
Terms of use.
The purchase of a digital file does not imply the acquisition of copyright over the work.
Unless expressly stated otherwise, the buyer receives only a personal, limited and non-exclusive license to use the file in accordance with the terms indicated on the product page.
It is prohibited:

Sharing it publicly.
Distributing it free of charge.
Uploading it to image banks.
Using it to create products intended for sale.
Using it as an element of a brand without authorization.
Licensing it to third parties.

Prices
All product prices shall be shown in euros (€).

Where legally applicable, prices shall include the applicable taxes.

Errors in prices

Availability

In the case of original works and limited editions, the number of available units may be small.
If a purchased product were exceptionally unavailable, La Correa Creativa will inform the customer as soon as possible and will, where applicable, refund the amounts paid.
The unavailability of a product may not be used to replace it with a different one without the customer's consent, except in the cases provided for by law.

The confirmation will be kept in electronic form and may be used as proof of purchase.

The processing of data associated with the payment may be carried out directly by the payment service provider.
For information on the processing carried out by Stripe, the customer should consult that provider's terms and privacy policy.
Shipping
Physical orders will be shipped via Correos, unless another system is expressly indicated for a specific order.
Shipping costs will be calculated according to:

The applicable amount will be shown before completing the purchase.
Shipments will be made to the address provided by the customer.
The customer is responsible for checking that the delivery details provided are correct.
Preparation and delivery times

Unless another period has been expressly agreed, the law establishes that the trader must fulfil the order without undue delay and, as a general rule, within thirty calendar days from the conclusion of the contract.

If a significant delivery delay occurs, La Correa Creativa will inform the customer when it becomes aware of the issue.
Where consumer legislation applies, the customer may exercise the corresponding rights in the event of failure to meet delivery times.
Receipt of the order
The customer must check the external condition of the package upon receipt.
If the packaging shows visible damage that may indicate damage to the contents, it is recommended to record this with the carrier and contact La Correa Creativa as soon as possible.
If the product shows damage, defects or lack of conformity, the customer must notify:

The notification should include, where possible, photographs of the product and the packaging.
The purpose of taking photographs is to facilitate handling of the issue and does not limit the consumer's legal rights.
Risk during transport
In sales to consumers, the risk of loss or accidental deterioration of the product is governed by consumer protection regulations.
As a general rule, the risk will not pass to the consumer until they, or a third party indicated by them other than the carrier, have acquired material possession of the goods.
Right of withdrawal
Where legally applicable, the consumer has a period of 14 calendar days to withdraw from the purchase without giving any reason.
In the sale of goods, the period begins on the day the consumer, or a third party indicated by them other than the carrier, acquires material possession of the goods.
The exercise of the right of withdrawal may not be subject to any penalty.
How to exercise the right of withdrawal

Unless La Correa Creativa offers to bear them, the direct costs of returning the products will be borne by the customer.
The customer will be responsible for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Refund
In the case of a valid withdrawal, La Correa Creativa will refund the amounts received from the customer, including the delivery costs corresponding to the standard shipping option offered.
If the customer chose a delivery option more expensive than the least expensive standard option offered, the corresponding extra cost will not be refunded.
The refund will be made using the same payment method used for the purchase, unless the customer has expressly agreed to another method that does not generate costs for them.
The refund will be made within the legally established periods.
Exceptions to the right of withdrawal
The right of withdrawal will not apply in the cases expressly excluded by law.
In particular, it may be excluded:

In the case of goods made to the customer's specifications or clearly personalized.
Digital content
In the case of digital content not supplied on a tangible medium where performance has begun with the customer's prior consent, provided the legal information requirements have been met and the customer has acknowledged that they lose their right of withdrawal.

The exclusion of withdrawal does not affect the consumer's legal rights in the event of lack of conformity or breach.
Digital downloads and loss of the right of withdrawal
When a digital product is delivered by immediate download and the law requires the customer's prior consent to begin performance before the withdrawal period ends, the purchase process will include an express confirmation in which the customer:

These characteristics will not in themselves constitute a lack of conformity when they are inherent to the handmade and artistic nature of the product and have been reasonably disclosed before the purchase.
Limited edition prints
Prints will be produced within the edition indicated on the product page.
The natural variation inherent to certain printing, paper or finishing processes will not necessarily constitute a lack of conformity when it corresponds to the advertised characteristics of the product.
If a received print shows a defect, damage or lack of conformity that does not correspond to its advertised characteristics, the customer may exercise their legally recognized rights.
Certificates of authenticity
Original works will be delivered with a certificate of authenticity when so indicated on the product page.
The certificate may include:

The certificate attests to the authenticity of the purchased work, but does not imply any transfer of intellectual property rights.
Intellectual Property

The purchase of a physical product does not imply the transfer of exploitation rights over the work.
Unless expressly authorized in writing, it is prohibited to:

Publishing photographs of the work on social media for personal purposes does not in itself imply any transfer of copyright.
However, the image of the work may not be used for commercial, advertising, editorial or promotional purposes without authorization from La Correa Creativa where such use implies exploitation of intellectual property rights.
Use of the works in artificial intelligence systems
The works, images, photographs and reproductions published on the website are not offered under a license permitting their use to train artificial intelligence models.
Unless expressly authorized, the following is prohibited:
- Automated extraction of images
Incorporating the works into training datasets.
Use for machine learning.
Generating derivative works from the works using AI systems.
Commercial exploitation of results derived from such uses.
This clause is without prejudice to the limits, exceptions and rights recognized by the applicable law.
Order cancellation
The customer may request the cancellation of an order by contacting:

The possibility of cancelling an order will depend on its status.
If the order has not yet been prepared or shipped, La Correa Creativa will endeavour to process the cancellation.
If the order has already been shipped, the customer may, where applicable, exercise the right of withdrawal in accordance with these terms and the applicable law.
In the case of custom commissions that have already begun, cancellation will be governed by the particular conditions accepted for the commission and by the applicable law.
Fraudulent or suspicious orders
La Correa Creativa may request additional information or take reasonable measures when there are signs of fraud, identity theft, unauthorized use of payment methods or any other circumstance that could compromise the security of the transaction.
Where necessary, the order may be cancelled and the amount paid refunded.
Invoicing
La Correa Creativa will issue the corresponding invoice or proof of purchase in accordance with the applicable tax regulations.
The customer must provide correct and complete invoicing details where required.
Invoices and documents related to the transactions will be kept for the legally established periods.

The limitations of liability contained in these terms will not apply where the law does not permit such limitation.
Force majeure
La Correa Creativa will not be responsible for delays or failures caused by circumstances reasonably beyond its control, provided the legally applicable requirements are met.
Such circumstances may include certain unforeseeable or unavoidable events that temporarily prevent performance of the contract.
When such a circumstance occurs, La Correa Creativa will inform the customer where reasonably possible.
Amendment of the terms
